Permissions
JKF will seek and/or grant permissions on all copyrighted
materials used in its publications in line with existing copyright
laws. Procedures
Permission must be sought from copyright holder for any
materials used in JKF books. Requests for such permissions must
indicate the passage being used, the publisher, the year of publication,
the authors, the type of book in which the passage will be reproduced
and the approximate selling price, the territory for which the book
will be sold, and the print run indicating whether permissions sought
is for one time reproduction or for all printing. A simple permissions
letter is included as Appendix 3.
Anybody seeking permission to use copyright materials from any
JKF publication shall be required to do the following:
- Provide a written request to the Managing Director.
- State the intended use for the copyright materials.
- Provide a sample of the material as quoted or adapted.
- State the territory for which the books will be sold.
- State the print run.
- State whether permissions sought is for one time or all time
printing.
1.01 Permissions gratis
The company shall grant permissions gratis in the following circumstances:
- Where the intended publication promotes JKF's corporate goals
and interest in a significant way.
- To publisher who maintains a reciprocal relationships with JKF
with regard to permissions.
- In a single edition (but not a single printing). New editions,
paperbacks, reprints, serialization in periodicals and other media.
Will require renewed permissions.
- Where the intended use constitutes fair use.
1.02 Acknowledgements
In addition publishers granted permissions to reproduce material
shall be required to:
- Acknowledge at the point of reproduction and on the acknowledgements
page.
- Provide at least two free samples upon publication of the book.
- State the author's), title, year of publication, edition and
place of publication of the quoted material.
1.03 Text Materials
- The charges on these materials will depend on the following:
- The intended use on the material-that is whether it is for commercial
or social purposes.
- The level at which the material is going to be used, i.e primary,
secondary or terxiary.
- The extent of material to be reproduced.
1.04 Graphics, Tables and Photographs
These will be paid for according to their complexity and the purpose
of their use.it will also depend on how important they are and the
initial cost of production. Reproduction sizes will be a factor
in cases of maps and large pictures.
1.05 Moral Rights
Moral rights to the right to be identified as author, i.e the right
of attribution;the right of integrity, i.e the right not to treat
the work in a derogatory way thus damaging the author's reputation;the
right not have the work falsely attributed to an author;and the
right of privacy to photographs and films commisioned for private
use.
No permission shall be granted if in the opinion of the foundation
the intended use violates the rights of the author in any way. |
